1. Acceptance and Service Description
By downloading or utilizing Provenant, you are entering into a binding agreement with Oakland Labs LLC and agreeing to these Terms of Service. Provenant is designed as a personal collection management tool specifically for tracking autographs and sports memorabilia. Our service includes features such as local data storage, optional cloud synchronization, public profile customization, and competitive group leaderboards. Please note that while core features are available for free, certain advanced functionalities require a paid premium subscription.
2. Account Requirements and Billing
To utilize cloud synchronization, you must create an account using a valid email address and be at least 13 years of age. You are solely responsible for maintaining the security of your credentials and for all activities that occur under your account.
Our Free Tier is supported by advertisements, while the Premium Subscription removes ads and unlocks additional features. All subscriptions are processed through the Apple App Store or Google Play Store on a monthly or annual basis. You may cancel your subscription at any time via your device settings; however, we do not provide refunds for partial billing periods, and access to premium features will terminate at the end of your current billing cycle.
3. Content Ownership and Acceptable Use
You retain full ownership of all content you input into the app, including item details, photographs, and personal notes. By enabling cloud sync or public profiles, you grant Oakland Labs a limited license to store and display this content specifically to facilitate those services.
In return, you agree to use the app lawfully and ethically. This includes refraining from infringing on third-party intellectual property, attempting to reverse-engineer the software, or using public features to harass other collectors.
4. Disclaimers and Liability
Provenant is provided on an "as-is" basis without warranties of any kind. Any item values displayed within the app are intended for personal tracking purposes only and do not constitute professional appraisals or financial advice. Oakland Labs is not liable for data loss resulting from device failure or unauthorized account deletion.
To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the service in the twelve months preceding the claim. These terms are governed by the laws of the State of New York.
